These Terms govern your use of the website padworks.io (the "Site"), operated by Martín Campos, operating as Pad Works ("Pad Works", "we", "us"), based in Santiago, Chile. By using the Site you accept these Terms.
1. What the Site is
The Site presents and sells Pad Works audio plugins for macOS and offers free downloads of selected products. Product pages, demos, and documentation are provided for information; specifications may change between versions.
2. Purchases — Merchant of Record
All purchases on the Site are processed by Lemon Squeezy, LLC acting as Merchant of Record. This means Lemon Squeezy is the seller of record for the transaction: it handles checkout, payment, invoicing, applicable taxes (VAT/sales tax), and refund execution under its own terms (lemonsqueezy.com/terms). Your license to use the software itself is granted by Pad Works under the End User License Agreement.
Refunds. If a Pad Works plugin doesn't work on your system, contact us within 14 days of purchase and we'll make it right — a fix or a full refund. Refunds are processed through Lemon Squeezy, our merchant of record. Full policy: padworks.io/refunds.
3. Intellectual property
The Site and its content — product names (Pad Works, PUNCH, BALANZE, and the other plugin names), logos, graphics, text, screenshots, audio demos, and design — are the property of Pad Works or its licensors and are protected by copyright and, where applicable, trademark law. You may not copy, reproduce, or redistribute Site content without permission, except for normal browsing, linking, and fair/quotation use (e.g. reviews).
Software downloads are governed by the EULA, not by this section.
Third-party names that may appear on the Site (e.g. DAW names such as Ableton Live or Logic Pro, or format names such as VST3 and Audio Units) are trademarks of their respective owners, used only to describe compatibility. VST is a trademark of Steinberg Media Technologies GmbH. Open-source components used in our software are listed at padworks.io/legal/third-party-licenses.
4. Free downloads
Free products are provided as-is under the EULA. Download links may point to third-party hosting (GitHub Releases); availability is not guaranteed.
5. Acceptable use
Don't attempt to disrupt the Site, scrape it at abusive rates, misuse checkout flows, or use the Site for anything unlawful.
6. Disclaimer and limitation of liability
THE SITE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, PAD WORKS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SITE. FOR CLAIMS RELATING TO PURCHASED SOFTWARE, THE LIABILITY CAP IN THE EULA APPLIES. Nothing in these Terms limits mandatory consumer rights under your local law.
7. Links to third parties
The Site links to third-party services (Lemon Squeezy, GitHub, YouTube, etc.). We are not responsible for their content or practices; their own terms and privacy policies apply.
8. Changes
We may update these Terms; the effective date above will change when we do. Continued use of the Site after changes means acceptance.
9. Governing law
These Terms are governed by the laws of the Republic of Chile. Disputes shall be resolved in the ordinary courts of Santiago de Chile, without prejudice to mandatory consumer venue rules that apply to you under your local law.
